These Terms of Service ("Terms") govern your use of the On-it Construction website and services provided by Kantor & Smith LLC DBA On-it Construction LLC ("On-it Construction," "we," "us," or "our").

1. Services Provided

On-it Construction provides commercial facility maintenance and repair services nationwide, including but not limited to plumbing, HVAC, handyman services, electrical, drywall, painting, and more. We offer both scheduled and emergency 24/7 service.

2. Service Engagement

Service terms, scope, and pricing are determined on a project-by-project basis through quotes and invoices.

Emergency services may be subject to premium rates outside of regular business hours.

3. Payment Terms

Payment terms are are agreed upon with each client. Invoices are due within the agreed-upon timeframe.

4. No Warranties

All services are provided "as is" without warranties of any kind, express or implied. While we strive for quality workmanship, we make no guarantees regarding specific outcomes or results.

5. Limitation of Liability

To the fullest extent permitted by law:

- Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, business interruption, or property damage beyond our direct work.
- We maintain appropriate insurance coverage for our work. Claims for property damage should be directed to our insurance carrier.

 

6. Licensed and Insured

On-it Construction is licensed and insured to perform construction and facility maintenance services. Certificates of Insurance (COI) and W-9 forms are available upon request.

 

7. Cancellations

If a service call is canceled after a technician has been dispatched, service call fees may apply.

 

8. Indemnification

Client agrees to provide safe access to work areas and utilities as needed. Client is responsible for ensuring our technicians have appropriate access to perform requested services.

 

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or our services shall be resolved in the appropriate courts located in Tampa, Florida.

Both parties agree to attempt to resolve disputes through good faith negotiation before pursuing legal action.

 

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this website. Continued use of our services constitutes acceptance of modified Terms.

 

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
